The NYC Soda Ban Has Been Overturned

Well, that was a tempest in a teapot. Right after we posted our incredibly helpful breakdown of how the soda ban would affect people in NYC (you’re welcome!), news broke that, in fact, a judge has invalidated the proposed regulations.

Justice Milton A. Tingling Jr. of State Supreme Court in Manhattan is the man who Mountain Dew lovers will be celebrating in the streets. Among the reasons he dismissed the ban as “arbitrary” and “capricious” are the following:

  • “It applies to some but not all food establishments in the city.”
  • “It excludes other beverages that have significantly higher concentrations of sugar sweeteners and/or calories.”
  • It exempted certain sugary drinks, including those with high milk content, even if they actually contained more sugar than a soda.
